What is the law regulating criminal cases in Slovenia?

Criminal cases in Slovenia fall under the provisions of the Criminal Code (which defines criminal offences and sanctions) and the Criminal Procedure Act (which regulates criminal proceedings; one of its main functions is to safeguard the rights of the innocent persons who have been accused of committing a crime).

In Slovenia, just like in other European countries, the premise of criminal law is that a person is considered innocent until the law, through its proceedings, establishes otherwise. Criminal cases can be heard in the following types of courts:

  1. local courts (there are 44 such courts, according to the European Judicial Network), where less serious criminal cases are heard;
  2. district courts (11 courts) – they can judge over criminal cases for which local courts do not have jurisdiction and such cases can be juvenile criminal cases, violations of human rights, execution of criminal sentences, etc;
  3. higher courts (4 courts) – these courts analyze appeals for cases judged by the previous courts;
  4. supreme court (1 court) – the highest court in Slovenia.

The structure of the panel that will judge a case varies from one court to another. For instance, in local courts, the cases will be heard and judged by 1 judge, while cases brought in front of district courts are generally heard by a panel of 1 judge and 2 lay judges.

It must be noted that in special criminal cases the trial will be heard by a panel of 5 members (2 judges and 3 lay judges). This can happen in cases of criminal offences punishable by 15 years of imprisonment or more, according to the Supreme State Prosecutor’s Office. Our law firm in Slovenia can offer assistance in all types of Slovenian courts.
